Powers of Functionaries

State Level Functionaries

President

  1. The President shall preside all the meetings of the committee and at all General Meetings and lead all deputation. He may address the members at annual general meeting on such subjects as he may deem proper but such address may not necessarily represent the views of the committee.
  2. He will lead all delegation to Government or Non- Government Organizations.
  3. He will Conduct press conferences and issue Press Releases and will act as an sportsmen of the chamber
  4. The President will have discretionary power to spend/donate/contribute up to Rs. 5000 on any item or to any other body / Organization in order to promote/protect the interest of the chambers. However such total discretionary spending will not be more than Rs. 20,000 in a year.
  5. No Remuneration will be paid to President.

Vice-President. In the absence of the President, the Vice-President shall exercise all the powers and duties of the President

General Secretary:

  1. No remuneration except out of pocket expenses as admissible  will be paid to or received by such General Secretary.
  2. The General Secretary shall be the executive officer of the chamber and he shall be responsible for the administration and affairs of the Chamber within the rules and regulations of the Chamber and shall perform his Cuties as per the directions of the executive committee He shall be in charge of the Chamber  secretariat. He shall maintain ail records; send out notices of the meetings and records and perform all other duties incidental to his office, He shall institute, prosecute and defend suits and other proceedings in which the Chamber may be involved. He shall prepare the minutes of meetings of the committee. He may be assisted by the paid Executive Secretary.
  3. Report : A yearly report of the working of the Committee prepared, printed and circulated for the information of the members of the association at least 15 days prior to the annual  general meeting and shall be submitted to such meeting for adoption .
  4. Secretary. The Secretary shall per-form all or any of the duties as may be assigned by the Executive Committee/ General Secretary from time to time .
  5. Finance Secretary. He will operate the accounts  and finance along with  any one of President or General Secretary of state body as co-signatory and prepare/ present annual accounts.
  6. Powers of the Executive Committee : The mananagement of the business of the Chamber shall be vested  in the Committee. ln addition to the powers by these provisions  expressly conferred upon them, the committee shall be entitled  to exercise all such powers and do all such things and act as may be exercised or done by the Chamber as including  the carrying out of all objects of  Chamber as set forth herein that  any of them is not hereby or by law expressly directed as required to be exercised by the chamber in the general meeting. Without  prejudice to the generality of the powers by  provisions hereof , the committee shall have powers:
  • To make vary and repeal rules for the regulation of the business of the chamber of the officers or servants or of the members of the chamber of any chapter of section of chamber.
  • To enter into arrangements upon such terms of subject such conditions as the committee may deem proper for working in conjunction with any other association organized for the propose of protecting or furthering of the development of the object for which such association is or shall be formed and are not inconsistent with the objects of the chamber
  • To nominate representatives to different bodies either Governmental or otherwise on behalf of the Chamber.
  • To  borrow or raise money from its bankers or other sources for  the conduct of the business of the Chamber and to invest money not immediately required.
  • To open bank accounts and to authorize any officer of the Chapter to operate upon such accounts.
  • To commence, institute. prosecute and defend such actions suits as the committee thinks fit and to arrange the service of such persons or advocates as it may think proper for the purposes of the Chamber.
  • To incur and pay all expenses for carrying out the aims and objects of the Chamber.
  • To undertake the settlement of disputes between merchants, industrialists and financiers in the course of their business and to settle them by arbitration.
  • To appoint from time to time or to remove such clerks and servants in the employment of the chamber as the committee shall think fit ; to fix their remuneration to be paid.
  • And generally to do all such acts and things as are conducive to the attainment of the objects of the Chamber.
  • Sub Committees: The Executive Committee may appoint District Committee departmental/ regional and/or sub-committee of the members of the  committee and/or of the Chamber with specific duties and functions on permanent and /or temporary basis  as the committee may determine. lt may also make vary and repeal rules for the regulation of the proceedings of such District, Departmental, Regional and Sub-Committees.
District Level Functionaries
2.1  Chapter Chairman & Vice-Chairman

2.1.1    A Chapter Chairman & Vice-Chairman will enjoy powers  and duties at District Chapter as similar to that of the state President / Vice President as the state level respectively .
2.2  Chapter Secretary
2.2.1    District Chapter Secretary will be convener of all meetings and in general perform all such functions at District Chapter Level .
2.2.2    Secretary at State Level .He will send the monthly activity report to the state body .
2.3  Treasurer.The Treasurer of the District Chapter will operate all accounts at District level and will be one of signing authority of cheques along with either of Chairman or Secretary He will also issue receipt for collection of annual subscription/ any other contribution; will send the District dues to state Body and will prepare accounts/ balance sheet annually. The audited balance sheet should be sent to State President or General Secretary / Finance Secretary annually positively by may end of each year.
2.4  District Executive Committee.
2.4.1    The management of the business of the District Chapter shall be vested in its executive body.  ln addition to the powers by these provisions expressly conferred upon them, the committee shall be entitled to exercise all such powers and do all such things and act as may be exercised or done by the chapter as including the carrying out all or any of the objects of the Chamber as set forth herein.
